1. Overview & Definitions
Welcome to Sarthway, a digital logistics platform owned and operated by Sarthway Services ("Company", "we", "us", or "our"). This Privacy Policy applies to all Shippers, Transporters, Driver Partners, and visitors who access or use our mobile applications, web dashboards, APIs, and website (collectively, the "Platform"). Definitions used herein: • "Shipper" refers to any individual or business entity posting loads, requesting transportation services, or utilizing our Platform to relocate goods. • "Transporter" / "Fleet Owner" refers to any user managing multiple drivers, booking trips, or managing transport fleets. • "Driver Partner" refers to independent operators or fleet drivers carrying cargo, operating vehicles, and tracking shipments. • "Personal Data" means any information relating to an identified or identifiable natural person.
2. Information We Collect
Sarthway collects information to provide, coordinate, and optimize logistics dispatch services. We collect data via three main channels: A. Information You Provide to Us: • Account & Profile Information: When registering, you provide your Full Name, email address, WhatsApp number, profile photograph, and account passwords/OTPs. • Business Compliance & Verification Records: To prevent cargo theft and secure our marketplace network, we collect Goods and Services Tax (GST) registration numbers/certificates, Aadhaar Card details (and scans), and Driving License (DL) details for all Driver Partners. • Financial Information: Bank details (Bank Name, Account Number, IFSC code), billing statements, and transaction histories to settle wallet balances and commission payouts. B. Information Collected Automatically: • Precise Location Data (GPS): - Driver Partners: Sarthway collects precise real-time location data (latitude and longitude) from mobile devices when the Sarthway App is open or running in the background (even when the app is closed, not in use, or when the screen is locked) to support live cargo tracking, route calculation, and geofence-based OTP verification. - Shippers/Transporters: We collect foreground location data when you click to detect your current city or area. • Device & Hardware Specifications: Device manufacturer, hardware model, operating system version, browser user-agent strings, system language, IP address, and network carrier. • Usage and Transaction Logs: Detailed records of bids placed, trips accepted, transit durations, geofence verification stamps, and app crash logs.
3. Disclosures on Device Permissions & Background Tracking
To execute digital cargo transport operations, Sarthway requires specific hardware permissions on your device: • Background Location Access: Driver Partners must grant continuous background location access. This is a core requirement to keep Shippers informed of delivery ETAs, update active routes, and verify geofence arrivals. We prominently prompt for this access during app setup. • Camera and Media Gallery: Used to capture and upload verification documents (e.g. GST certificates, Aadhaar cards, Driver Licenses) and shipping forms (e.g. digital Form 13 or cargo photos). • Local Storage & Web Cookies: On web browsers, Sarthway uses localStorage, session tokens, and security cookies to authenticate sessions, prevent CSRF attacks, and remember search filters.
4. How We Use the Collected Data
Sarthway processes data for the following commercial purposes: • Routing & Dispatch Coordination: Matching Shippers who have pending cargo loads with nearby Transporters or Driver Partners equipped with the requested vehicle category (Tata Ace, Pickup Trucks, Heavy Trucks). • Trip Verification & Integrity: Generating and validating unique 6-digit OTP verification codes at the pickup point and delivery destination to ensure the correct cargo is handed to the authorized driver. • Financial Settlements: Administering the Sarthway wallet, executing payments, calculating commissions, and complying with GST tax regulations. • Customer Support & Helplines: Addressing inquiries, coordinating disputes, and contacting drivers during transit issues. • Safety & Fraud Prevention: Screening verification documents to protect shippers from fraudulent operators and secure cargo transit.
5. Advertising & Analytics Compliance (Google Policies)
• Google AdSense & AdMob: Sarthway displays ads served by Google. Google uses cookies or mobile Advertising IDs (such as Google Play Services AAID) to serve ads based on your previous visits to our Platform. • Personalized Advertising Opt-Out: - On Web: You can opt out of personalized ads by visiting Google Ad Settings (adssettings.google.com). - On Mobile App: You can manage or opt out of personalized advertisements via your Android device settings (Settings > Privacy > Ads) and selecting 'Opt out of Ads Personalization' or resetting your Advertising ID. • Analytics Providers: We use analytics tools (such as Google Analytics for Firebase) to collect aggregated, anonymous platform usage statistics.
6. Data Sharing, Disclosures, & Intermediary Protections
• User-to-User Sharing: We share Driver/vehicle details with the designated Shipper, and Shipper contact info/pickup coordinates with the Driver Partner/Transporter during active trips. • Third-Party Service Providers: We share data with Google Maps SDK (for routing), payment gateways, and WhatsApp/SMS alert dispatch systems. • Intermediary Status (Section 79 of Indian IT Act, 2000): Sarthway Services acts strictly as an online marketplace intermediary. We do not own, manage, or operate any vehicles directly, nor do we employ Driver Partners. Under Section 79 of the IT Act, 2000, Sarthway Services is not liable for cargo loss, damage, theft, payment defaults between users, vehicle accidents, delays, or misconduct. All disputes are governed under the exclusive jurisdiction of the courts in Kutch (Mundra), Gujarat, India.
7. Data Security Measures
We implement administrative, technical, and physical security measures to protect your information: • SSL/TLS Encryption: All data transmitted between your device and our servers is encrypted using Secure Socket Layer/Transport Layer Security (SSL/TLS). • Access Restrictions: Personal information is restricted to authorized employees, contractors, and agents who require access to manage logistics operations. • No Guarantee Disclaimer: While we employ industry-standard safeguards, no method of electronic storage or internet transmission is 100% secure. You share all files, documents, and credentials at your own individual risk.
8. Data Retention & Account Deletion Policy
• Retention Policy: Sarthway retains your personal data as long as your account remains active or as required to fulfill logistics, auditing, and tax compliance obligations. • Account Deletion (Google Play Compliance): You can request permanent account deletion directly through the app settings or via our designated deletion link: https://www.sarthway.com/delete-account. • Purging Window: Upon receiving a deletion request, your personal data, credentials, and verification records will be permanently deleted from our active databases within 30 days, except where retention is legally mandated (e.g. audit records, outstanding payment resolutions).
